Terms of Service

These Terms of Service ("Terms") govern your use of witchprompt.com and our API/MCP service (together, the "Service"), operated bySADHVIKAIR LTD, a company registered in England and Wales (company number 16642622, registered office: 3rd Floor, 86-90 Paul Street, London, England, United Kingdom, EC2A 4NE) ("WitchPrompt", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

WitchPrompt lets you create, host, and share reusable AI prompts and workspaces, and expose them to your own AI tools over an API and MCP (Model Context Protocol) server using an API key you control. Some features require a paid plan. We may add, change, or remove features at any time.

2. Accounts

• You must be at least 16 years old to use the Service.
• You're responsible for the accuracy of your account information and for keeping your credentials and API keys confidential.
• You're responsible for all activity that happens under your account and API keys.

3. Plans, billing, and the current promotion

• WitchPrompt currently offers a Free plan and a paid Pro plan, billed monthly or annually via Clerk/Stripe. A Team plan exists but is invite-only and not currently available for public signup.
• From time to time we may offer promotional pricing or trial periods (for example, a free trial period on Pro). the specific terms are shown at signup/checkout and may be changed, extended, or withdrawn at any time without affecting subscriptions already in progress.
• Paid subscriptions renew automatically at the then-current price unless cancelled before the renewal date. You can cancel any time from Settings → Billing; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees are non-refundable for partial billing periods.
• We may change plan pricing going forward; we won't change the price of a subscription you're already on without notice.

4. Your content

• You retain ownership of the prompts and content you create. By using the Service, you grant us a license to host, store, and display that content as needed to operate the Service, in line with the visibility (public/private) you choose for it.
• Content you set to "public" is intentionally discoverable by anyone on the internet without an account. don't mark anything public that you don't want publicly visible.
• You're responsible for your content and confirm you have the rights to share it. Don't upload content that's illegal, infringes someone else's intellectual property or privacy rights, or contains malware.

5. Acceptable use

You agree not to:

• Use the Service to violate any law or infringe anyone's rights;
• Attempt to gain unauthorized access to other accounts, workspaces, or our systems;
• Scrape, spam, or abuse the Service or its API/MCP endpoints beyond reasonable, good-faith use;
• Interfere with or disrupt the Service's operation or security.

We may suspend or terminate access for violations of this section.

6. Third-party AI tools and MCP

When you connect a third-party AI client or agent to WitchPrompt using your own API key, you control what that client can access and what it does with the content it retrieves. We're not responsible for the actions of AI tools you choose to connect, and your use of them is subject to their own terms, not ours.

7. Intellectual property

The WitchPrompt name, logo, and software (excluding your content) are owned by SADHVIKAIR LTD. Nothing in these Terms transfers any of our intellectual property to you.

8. Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you breach these Terms, and will give notice where reasonably possible except in cases of suspected fraud, abuse, or legal risk.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or always available.

10. Limitation of liability

To the maximum extent permitted by law, WitchPrompt/SADHVIKAIR LTD won't be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose (or £0 if you're on the Free plan). Nothing in these Terms limits liability that can't be limited by law (e.g. for fraud or death/personal injury caused by negligence).

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from your content or your misuse of the Service, to the extent permitted by law.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of England and Wales.
